Circuit Judge Donald W. Hafele was the trial-level judge in Palm Beach County who repeatedly denied efforts to unseal the secret grand jury transcripts from the 2006 grand jury that investigated Jeffrey Epstein in Florida. When media organizations such as The Palm Beach Post and others petitioned the court to release the secret testimony that might explain why Epstein received a lenient plea deal, Hafele ruled that under existing Florida law he did not have the authority to release those normally confidential records, even though public interest arguments were made about transparency and justice. His rulings maintained the traditional secrecy of grand jury proceedings and kept the transcripts sealed.

That decision was overturned by the Florida Fourth District Court of Appeal, which unanimously concluded that Hafele had erred in saying he lacked authority to release the records. The appeals court ruled that under state law grand jury records could be made public if doing so would “further justice,” and ordered Hafele (or the trial court) to review the materials and determine which parts could be released with appropriate redactions. In effect, Hafele’s earlier closure was not the final word; the appellate ruling opened the door to unsealing at least portions of the grand jury transcripts, marking a key shift in the long battle over access to these Florida records.
