EU Opti-In vs US Opt-Out

EU Opti-In vs US Opt-Out

Author: Punit Bhatia | Data Privacy, Sourcing & EU AI Act Specialist | ISO Standards April 30, 2026 Duration: 10:16

Why does Europe follow an opt‑in model, while the US relies on opt‑out?

In this trailer, we explore two fundamentally different approaches to privacy:

  • EU (Opt‑In) – No data is collected until the user gives explicit consent

  • US (Opt‑Out) – Data can be collected by default, but users can decline or restrict usage later

They also discuss:

  • Why the US adopted an opt‑out approach, partly due to legal and constitutional considerations

  • How California is improving the model through tools like one‑click opt‑out and deletion systems

  • Why the goal is shifting toward making privacy easier and scalable for consumers

As AI and data-driven technologies grow, these models shape how users control their data and how businesses operate globally.
